【Abstract】

This paper is to discuss the method oftraditional Chinese medicine principles and key elements of legislation, aswell as perfect legal system of Chinese medicine. Basic principles ofChinese medicine law should promote sustainable development ofChinese medicine principles, follow the laws of the development of Chinesemedicine principles, principles of traditional Chinese medicine and medicineand modern technology. Key element of the legislation includes theestablishment of the perfection of management system of Chinese medicine. Governmentmeasures to support the traditional Chinese medicine, and the specific systemrequirements. In the establishment of legal system of Chinese medicine, majormeasures were cleaned, to consolidate existing laws and regulations, speed up thelocal legislation, accelerating the compatibility of legislation.

The threeparts of this article are as follows:

1. Basic principles of Chinese medicine law

(1) Adhere to the principle of both Chineseand Western medicines

(2) Principle of protecting thesustainable development of TCM

(3) Principle of showing special andadvantage of TCM and follow the law of TCM’s development

(4) Adhere to the principle of coordinateddevelopment of TCM

2. The main contents of Chinese medicine law

(1) The management system of TCM

The management system of TCM is notperfect: Central and provincial management institutions relativelycomplete, but many local Chinese medicine institutions atthe grass-roots base does not exist.

(2)National measures to support the development of TCM

The state council issued a several viewson supporting and promoting the development of TCM in 2009, and the formulationof the Chinese medicine law is an embodiment of policy.

(3) All aspects of Chinesemedicine system

Authors summarize ten system:Chinese medicine education, inheritance system; system of the use ofTCM professionals; the settings and functions of TCM organization; the occupationalconditions of TCM doctors; development and production of TCM; TCM intellectualproperty protection; the popularization and promotion of knowledge of TCMeducation; standardization of  TCM; modernization of TCM; internationalization of TCM.

3. Perfecting the system of ChineseMedicine

Speeding up legislation on TCM is available from the following aspects tostrengthen:

Using an integrated westernmedicine law separated legislative models; speed upthe local legislation of TCM; speedup the local Chinese medicine legislation; Acceleraterelated legislation actively.
