Research on GMF Safety Social Regulation in China

AbstractTraditional food safetyregulatory model has been difficult to meet the multiple hazards of geneticallymodified food properties. The actual harm, potential harm, mental harm, with the social power and the risk society theory basis of social regulation is meaningfulfor the problems about monopoly of power, limited means, limited scope, single goal. But the social regulation is restricted by technology and legal factor sand it is difficult to achieve. Improve the GMF technology and cognitive level,strengthen the legal system of rationality and social power security can solve theproblem very well.

This article can be divided into three parts:

The first part introduced the theories of the GMF safety social regulation. On the aspect of the regulatory requirements and regulatory bodies, it reflects the theory of social rights. However, when it comes toregulatory methods and boundary of intervention, it reflects the risk society theory.

The second part introduces the barriers to realize GMFsafety social regulation. It usually includes two factors. One is technological constraints and the other one is for law constraints. Firstly, the transgene technology might have downside risk. Secondly, there is a technology limitationon GMF risk monitoring. Thirdly, the GMF safety legislation lacks the recognition on its hazard properties. Fourthly, the GMF safety legislation lacks the recognition on social rights guarantee.

The final part introduces the countermeasures of realizing GMF safety social regulation. Firstly, it should develop the scientific technology on GMF research. Secondly, it should promote the social perceptionon GMF common sense. Thirdly, it should enhance the rationality on legal system. Fourthly, it should strengthen the supportability on social rights.
