Huaer,a folk song which is popular in Gansu, is one of the world intangible cultural heritage projects, and has been listed into the protection list by the United Nations Educational, Scientific and Cultural Organization. Linxia, a prefecturein Gansu, is the birthplace and spreading ground of Gansu Huaer.

Although Gansu Huaer has a broad mass base, it also encounters some difficulties on the inheritance and development for a long time, which restricts the healthy development of its’ protection work. For instance, it is short of inheritors and sound selection as well as training mechanisms of professional talents. Besides, the activities are nongovernmental, lack of governments’ support and guidance. In addition, there are a few related cultural products.

Therefore, in order to inherit and carry forward the culture of Gansu Huaer, it is of great significance to give effective protection to it by legislation.

Recently, the twenty-second session of the twelfth session of the Standing Committee of NPC of Gansu Province reviewed and approved “ The Regulations on Protection and Inheritance of Gansu Huaer in Linxia Hui Nationality Autonomous Prefecture, Gansu Province”. It provides effective protection of Gansu Huaer in the form of legislation which can better inherit and promote the culture.

For the protection and utilization of Gansu Huaer, the regulations provide that governments at or above the county level in the Autonomous Prefecture shall se tup special funds for the protection and inheritance of it, mainly used for rescuing,recording, investigating and sorting as well as the collection and preservation of raw data and material objects. What’s more, the special funds are also used for lyrics research, results ,publication and distribution. The investment of overall protection of the conference halls, the support for professional inheritors and researchers training, the aid for performance and cultural propaganda, the construction and maintenance of show places, the assistance for researches and communication, the reward for the units and individuals that have outstanding contributions in the protection, inheritance, propaganda andresearches and the reward for outstanding films, television works andliterature should be imbursed by the special funds.

There gulations also encourage citizens, legal persons and other organizations rationally use the cultural resources on the basis of effective protection anddevelop related cultural products and tourism service projects. It regulatesthat the use of cultural resources should respect the authenticity and cultural connotation, maintaining the original cultural ecology and cultural style.

The regulations make clear provisions on the qualifications of representative inheritors, the rights and the obligations. It requires that the cultural administrative departments at or above the county level in the Autonomous Prefecture should assess the representative inheritors every two years. If the assessment is not qualified, the cultural administrative departments shall order deadline for rectification. And if the rectification is still not qualified,the original identification department should disqualify the inheritors.

The regulations formulate that cultural administrative departments in the autonomous prefecture should establish and improve the protection, inheritance and development mechanism of Gansu Huaer, mining and cultivating folk inheritors. To encourageand support all kinds of cultural and artistic organizations and individuals to carry out the activities of Gansu Huaer’s performance, exhibition, inheritanceand so on. The qualified schools at all levels in the autonomous prefecture candevelop the popular books for students, carrying out the teaching activities of Huaer to teach and spread the basic knowledge of Huaer and foster the talents of Huaer.
