“Toimplement rescuing conservation of the disappearing intangible cultural heritage projects; to carry out productive conservation of traditional crafts,arts, herbal preparation with productive techniques; to preferentially list eligible Chinese andShanghai time-honored brand enterprises into the intangible cultural heritage list. ”The Regulations on the Protection of Intangible Cultural Heritage in Shanghai (hereinafterreferred to as the Regulations on theIntangible Cultural Heritage) will be put into force on May 1st. There aremore laws to go by for the protection work of intangible cultural heritage in Shanghai .

Inview of extensive categories and rich in content, the shapes, living conditionsand inheritance situations of intangible cultural heritage varies from one toone. The Regulations on the Protection ofIntangible Cultural Heritage in Shanghai has established the principle of classification protection of intangible cultural heritage and demanded to lay special stress on protecting the disappearing or Shanghai unique intangible cultural heritage representative projects with historical and cultural value.

As for the disappearing intangible cultural heritage representative projects，the protectionunit should implement rescuing conservation, such as recording and sortingtheir contents, forms and technique processes, printing books, making video data, establishing archives and so on. As for intangible cultural heritagere presentative projects with productive skills and social needs, such as traditional crafts, traditional arts, traditional herbal preparation, theone that can transform into cultural products with the help of production,circulation and sales, the protection unit should carry out productive conservation through supporting, guiding and standardizing the rational development and utilization of the projects.

There are laws to go by for the protection and inheritance of traditional crafts . As for the behaviors for commercial interests under the guise of intangible cultural heritage protection, especially those excessively commercialize in tangible cultural heritage projects in the tourism industry, the Regulations on the Protection of IntangibleCultural Heritage in Shanghai also clearly defined that the use of intangible cultural heritage should maintain its original cultural ecology and cultural landscape on the principle of respecting the original authenticity,cultural connotation and natural evolution process and shall not distort,disparage or abuse it.

Meanwhile,the Regulations on the Protection of Intangible Cultural Heritage in Shanghai established periodic evaluation system so as to restrain the inheritance process of intangible cultural heritage projects. It also required themunicipal, district and county Cultural Administration Departments to assess the representative projects at the corresponding level every three years andmake the results public. Where there is no good reason for not fulfilling the obligations, it shall be ordered to make rectification within a time limit. If no correction is made within the time limit, it may cancel the qualifications of the representative successors or the unit of protection, and shall be reidentified.
